Petitioner has filed this writ petition with following prayers:- "It is, therefore humbly prayed that Your Lordship may graciously be pleased to accept and allow this writ petition and by an appropriate writ, order or direction:- 1. Quashed and set aside the order dated 28.03.2023 along with district allotment list passed by the Respondents by which they give the posting at District Dausa to the petitioner on the post of Village Development Officer. [2026:RJ-JP:7999] (2 of 3) [CW-19555/2023] 2. the respondents may further kindly be directed to give posting to the petitioner at District Alwar as First Preference and Jaipur as Second preference, on the post of Village Development Officer. 3. Any other appropriate order, which may be found just and proper in the facts and circumstances of the case, be passed in favour of the petitioner. 4. Cost of the writ petition may also be awarded in favour of the petitioner." 2. Learned counsel for the petitioner submits that the petitioner succeeded in recruitment examination on the post of Village Development Officer pursuant to advertisement dated 06.09.2021. Learned counsel submits that while granting posting to all the selected and appointed candidates, process of counselling was adopted by the respondents and posting was to be given on the basis of merit-cum-preference. 3. Learned counsel submits that despite the fact that the petitioner was higher in merit, the request made by her by giving specific preference of posting was not accepted, whereas the persons who were lower in merit, their request has been accepted and they have been given their choice postings. Learned counsel also submits that the respondents cannot be allowed to adopt policy of pick and choose and being State employer, the respondents should prove themselves to be benevolent employer. Learned counsel submits that not accepting the preference given by the petitioner for posting is causing serious prejudice and miscarriage of justice to the petitioner, as husband of the petitioner, who is also in government service, is posted in another District, whereas the petitioner is posted at Dausa. Learned [2026:RJ-JP:7999] (3 of 3) [CW-19555/2023] counsel submits that although the petitioner has submitted representation pointing out all such illegalities in the policy of posting, yet the respondents have not paid any heed whatsoever. 4. In view of above, the writ petition filed by the petitioner is disposed of with liberty to the petitioner to file a fresh representation containing all the grounds raised in the instant writ petition and highlighting her grievances. In case, such representation is filed by the petitioner, same shall be considered and decided by respondent No.2 within a period of 60 days from the date of receipt of representation along with certified copy of this order. 5.
