ORDER This Criminal Miscellaneous Petition has been filed seeking to modify the condition No.(b) imposed in the order dated 19.02.2026 made in Crl.O.P. https://www.mhc.tn.gov.in/judis
(MD)No.14630 of 2025 by reducing the deposit amount of Rs.3,00,000/- to a reasonable lesser sum and permit the petitioner to deposit the same to the credit of Crime No.86 of 2025 before the learned Judicial Magistrate No.I, Nagercoil.
2. The learned counsel for the petitioner submits that the petitioner was
directed to deposit a sum of Rs.3,00,000/- (Rupees Three Lakh only), to the credit of Crime No.86 of 2025 before the learned Judicial Magistrate No.I, Nagercoil, as a pre-condition for granting anticipatory bail. He would further submit that the petitioner is not able to mobilise the funds and he could not deposit the said amount. Hence, he prays to modify the said condition.
3. Heard both sides and perused the materials available on record.
4. On careful perusal of the order passed by this Court in Crl.O.P. (MD).No.14630 of 2025, it is specifically stated that the petitioner had cheated the defacto complainant to the tune of Rs.12,50,000/- and though a sum of Rs.5,00,000/- was alleged to be repaid, the remaining cheated amount is Rs.7,50,000/-. Only after considering the above facts, this Court had directed the petitioner to deposit a sum of Rs.3,00,000/- while granting anticipatory bail and the same has not been complied with. Now, the petitioner seeks for modification of the condition on the ground that he could not mobilize the funds. The reason for non-compliance of the said condition is unacceptable and hence, this Court is not inclined to modify the condition imposed in Crl.O.P. (MD).No.14630 of 2025 dated 19.02.2026. However, if the petitioner https://www.mhc.tn.gov.in/judis
has chosen to deposit the aforesaid sum, he is entitled to deposit the amount within a period of fifteen (15) days from today. In the event of failure to make the payment within the aforesaid period, the order passed by this Court in Crl.O.P.(MD).No.14630 of 2025 dated 19.02.2026 shall stand automatically cancelled.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed. 07-07-2026 Lm To 1.The Inspector of Police, Kanyakumari Police Station, Kanyakumari District. 2.The Additional Public Prosecutor, Madurai Bench of Madras High Court. https://www.mhc.tn.gov.in/judis
