Case No. 196 of 2025 for the offence registered under Section 310(2) of the BNS, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj, is pressed into motion. As per the FIR, at 11 O’ Clock in the night when the informant was returning home, a highway dacoity was committed in which the informant was disrobed of his mobile phone, but the motorcycle could not be taken away as it was not in a good running condition. It is submitted by the learned counsel on behalf of petitioner that he was named in this case only on suspicion and there is delay in lodging of FIR by one day and he was not apprehended from the spot. Learned A.P.P. opposed the bail petition. It is submitted that the petitioner is named in the FIR and there is direct and specific allegation of committing highway dacoity and the petitioner has three criminal antecedents. Considering the seriousness of the allegation and the nature offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected.
