07.10.2026 Court No.35. M/L. 85. Kausik CRM (M) 2225 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dubrajpur Police Station Case No. 336 of 2025 dated 07.09.2025 under Sections 4/6 of the POCSO Act, 2012. And In the matter of : Kalidas Bhattacharya ……Petitioner. Mr. Md. Abdur Rakib Mr. Tirthapati Acharyya ……for the Petitioner. Mr. Parmanand Sharma Mr. Subhasish Pachal Mr. Harshit Jaiswal ….for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody since 07.09.2025 and has been implicated because he admonished the child for other reasons. Learned advocate for the State prays for an accommodation. The bail application was filed on 24.08.2026. As such, time prayed on behalf of the State in this case is not granted. I have taken into account the records wherein I have assessed the statement of the child under Section 183 of the BNSS as well as the Medico Legal Examination Report. 2 Having considered the same, I am of the opinion that petitioner be released on bail after the evidence of the victim boy is over. Learned Trial Court is directed to complete the said process within a period of 3 months from the next date fixed. Accordingly, prayer for bail at this stage is dismissed. Learned Trial Court would adhere to the directions passed above. With the aforesaid observations CRM (M) 2225 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
