BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 07.07.2026 CORAM THE HONOURABLE MR JUSTICE S. SOUNTHAR C.R.P(MD).No.1740 of 2026 M.S.Senthilkumar ... Petitioner Vs 1.Pandiyakula Salavaiyalargal Sangam rep., through its President, A.Perumal 2.A.Perumal 3.K.Jothikannan 4.R.Krishnan (Exonerated) ... Respondents (notice may be given up against R1, R2,R4) Prayer: Petition is filed under Article 227 of the Constitution of India, to allow this civil revision petition by setting aside the petition and order passed by the learned II Additional District Munsif, Madurai, in I.A.No.1 of 2024 in I.A.No.1208 of 2017 in O.S.No.785 of 2017 on 04.06.2026. For Petitioner : Mr.K.Neethimohan ORDER The civil revision petition is filed challenging the order passed by the Trial Court dismissing the application filed by the petitioner in I.A.No.1 of 2024 in I.A.No.1208 of 2017 in O.S.No.785 of 2017 dated 04.06.2026 seeking re-issue the warrant to the Advocate Commissioner, who already filed his report. 1/4 https://www.mhc.tn.gov.in/judis
2.It is seen from the impugned order that the petitioner sought for appointment of an Advocate Commissioner and the same was ordered. He also filed his report. Not satisfied with the report filed by the Advocate Commissioner, the petitioner filed an application in I.A.No.514 of 2018 seeking reissue the warrant to the Advocate Commissioner and the same was allowed. However, the petitioner failed to pay the remuneration to the Advocate Commissioner. Hence, subsequently, it was dismissed for default on 23.02.2024. The petitioner, instead of filing appropriate application to recall the order and to extend the time for payment of remuneration to the Advocate Commissioner, filed yet another application in I.A.No.1 of 2024 seeking reissue of warrant to the Advocate Commissioner. The Trial Court dismissed the said application on the ground that the second application for the very same prayer is not maintainable. I do not find any error in the approach adopted by the Trial Court and therefore, I am not inclined to interfere with the impugned order. Accordingly, this Civil Revision Petition stands dismissed. However, liberty is granted to the petitioner to file appropriate application before the Trial Court seeking recall of the order dated 23.02.2024 in I.A.No.514 of 2018 along with petition seeking extension of time for payment of remuneration to the Advocate 2/4 https://www.mhc.tn.gov.in/judis
Commissioner.
If any such application is filed by the petitioner, the same shall be considered in accordance with the law, in the light of the fact that the earlier prayer for reissue the warrant was already allowed.
