(Oral) Petitioner herein, who at present is working as Junior Engineer, at 132/133/11 KV HPSEBL Sub Station, Sub Division Gondpur, Paonta Sahib, District Sirmaur, Himachal Pradesh, is aggrieved of order dated 27.12.2025 (Annexure P-1), whereby he has been ordered to be transferred from afore station to 132/33/11 K Sub- Station Sub Division Kala Amb under ES Division HPSEBL Nahan vice one Sh. Komal Singh, who has been transferred vice-versa from Kala Amb to Gondpur. 2. Though it has been fairly admitted at the behest of the petitioner that petitioner has already completed normal tenure at present place of posting, but challenge has been laid to impugned - 2 - transfer order on the ground that petitioner is on the verge of retirement and as such, could not have been transferred to far flung area. 3. Having regard to the nature of order proposed to be passed, this Court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Rahul Thakur, Advocate, who states that petitioner has completed more than normal tenure at present place of posting and as such, no illegality can be said to have been done by the respondents while passing impugned order. 4. Having carefully perused averments contained in the petition, which is duly supported by an affidavit, this Court finds that petitioner was posted at present place of posting in the year 2020 meaning thereby, he has already served for more than five years at present place of posting, however, having taken note of the fact that petitioner is due to retire within two years, coupled with the fact that transfer policy enables an employee to seek adjustment to a convenient place on account of his/her nearing retirement, this Court deems it fit to dispose of the present petition reserving liberty to the petitioner to file representation to the competent authority within one week, praying therein for his adjustment at convenient station on the ground of his nearing retirement, which in turn shall be decided by the competent authority expeditiously, preferably, within ten days. - 3 - Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order taking note of the fact that one vacancy of Junior Engineer is stated to be lying vacant at HPSEBL Electrical Sub Division Dhaulakua and HPSEBL Electrical Sub Divisiosn Badripur, Paonta Sahib. Till the time representation filed by the petitioner within one week is decided by the competent authority, petitioner shall not be compelled to join at the transferred station.
