The petitioner is an accused in the case registered for the offences punishable under Sections 127(1)/127(2)/118(2)/ 123/109/140 & 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner is not named in the F.I.R. The main allegation is against co-accused-Dhananjay Saw, who allegedly administered poison to Shyam Kumar Mahto. The petitioner has been implicated in the present case only on the basis of alleged confessional statement of Karan Kumar Saw as one of the conduits. Except that, there is no other evidence against the petitioner to connect him with the alleged offence. The petitioner has no criminal antecedent as has been stated in paragraph No. 13 of the present bail application. The petitioner in judicial custody 2026:JHHC:5901 2 since 06.11.2025. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Dhanbad in connection with Govindpur P.S.
