Learned State counsel submits that challenge in this petition is to the order dated 27.01.2026, which is an order of transfer of petitioner from the office of Senior Agricultural Development Officer, Baloda, District - Janjgir - Champa to office of Senior Agricultural Development Officer, Pratappur, District Surajpur (C.G.). Under transfer policy, State Government has constituted a Committee to consider the grievance of BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN Date: 2026.02.17 17:07:23 +0530 2 employees against their transfer. Though petitioner has submitted representation before respondent No.1, however, he has not submitted any representation before the concerned Committee raising his grievance as raised in this petition. 2. Learned counsel for petitioner submits that in view of the objection raised by learned State counsel, he will file fresh representation before the Committee constituted under transfer policy. He further submits that petitioner is apprehending that he would be relieved in the mids of academic session as the exams of children is about to schedule. He further submits that no other person is posted in place of petitioner by the impugned order. Therefore, till the decision on the representation to be submitted by him, some interim protection may be granted. 3. On due consideration on the submission of learned counsel for parties as also the progress card of one of the child of petitioner, who is studying in Class-IV and in the State of Chhattisgarh, examination of the primary school is likely to schedule in the month of March as also taking note of the decision of Hon’ble Supreme Court in case of Director of School Education v. O. Karuppa Thevan, reported in 1994 SCC Suppl. (2) 666, this petition is disposed of permitting petitioner to submit fresh representation before the Committee constituted under transfer policy raising all the grounds as raised in this petition within two weeks and in turn, the concerned Committee is directed to consider and take decision on the claim of petitioner in accordance with law expeditiously preferably within further period of four weeks from the date of receipt of representation. 3 4. Till the decision is taken by the Committee on the representation to be submitted by petitioner, status-quo as it exists today with respect to place of posting of petitioner shall be maintained by the parties. 5.
