Prayer sought in the Writ Petition is as under: “……. to issue a writ order or orders, especially in the form of WRIT OF MANDAMUS, declaring the action of the Respondents in proposing to convert, alienate, assign, transfer, or allot the Grama Samudayapu Beedu/Grama Samudayam/Village Communal Waste/Poramboke lands admeasuring Ac. 316.078 cents situated in various LPM Surveys, including Survey Nos.1223, 1224, 1225, 1211, 112, 110, 90, 21, 172, 750, 67, 74, 78, 79, 49, 99, 1228, 1229, 1230, 1243, 838, 113, 117, 116, 92, 84, 91, 66, 63, 68, 72, 77, 83, 89, 76, 1948, 82, 1950, 88, 1949, 929, 927 Numbers of Garapadu Village, Pedakurapadu Mandal, Palnadu District, in favour of private companies or private entities for commercial or industrial purposes, as illegal, arbitrary, unconstitutional, violative of the Andhra Pradesh Board Standing Orders, contrary to the provisions of law, and violative of Articles 14, 21, and 300A of the Constitution of India, without issuing any notice is highly illegal, arbitrary and unconstitutional and consequently directs the respondents not to interfere with the peaceful .possession and enjoyment of the petitioners' properties situated in an extent of Ac. 316.078 and pass….” 3. Case of the petitioners is that they are enjoying the aforementioned lands and cultivating the same without any interruption. The subject lands are classified and recorded as „Grama Samudayapu Beedu‟, „Grama Samudayam‟, Village Communcal Waste‟ and „Poramboke lands, which are meant for common use, welfare and benefit of the villagers. The said classification is also reflected in the village revenue records. 4. It is further submitted that the petitioners came to know that the respondent authorities are proposing to convert and allot the subject lands for 4 commercial and industrial purpose. In this connection, the District Collector also inspected the subject lands. Hence, the petitioners submitted the representation dated 01.04.2026 to the respondent authorities requesting to refrain from proceeding with the proposed allotment and to protect the communal lands for the benefit of the villagers. 5. Learned Standing Counsel submitted the written instructions furnished by the Panchayat Secretary, Garapadu Village, Pedakurapadu Mandal, Palnadu District. Copy of it is also furnished to the learned counsel for the petitioners. 6. In the written instructions, it is clearly stated that the respondent authorities have no authority to convert the Gram Samudayapu Beedu/Grama Samudayam/Village Communal Waste/Paoramboke lands and further stated that they have not passed any resolution relating to conversion of thesubject lands. The written instructions are placed on record. 7. Having noted the same, the Writ Petition is disposed of, with a direction to the respondent authorities to dispose of the representation of the petitioners dated 01.04.2026 in accordance with law, within a period of four weeks from the date of receipt of copy of this Order.
