ORDER (Order of the Court was made by Dr.Anita Sumanth J.) In this petition the convict seeks relaxation of the condition imposed on
25.11.2025. In that order, the Court had suspended the sentence under judgment dated 25.04.2025 in S.C.No.1 of 2018 on the condition that the petitioner shall execute necessary bonds and sureties and that he shall appear before the trial Court every Monday at 10.30 a.m. till disposal of the appeal or in the alternate make a file an application under Section 317 and appear on any other day in view of the date of absence as directed by the trial Court. 2.Mr.Mohamed Riyaz, learned Government Advocate had sought time on the earlier occasion to verify whether the petitioner had been complying with the condition imposed, particularly in regard to his attendance. 3.Learned Government Advocate today on instructions confirms that the petitioner has been diligent in appearing before the Court as directed.
4. In light of the aforesaid, condition in S.No.(iii) imposed on 25.11.2025 is modified to read as follows: (iii) The petitioner shall appear before the trial Court on the first Monday of every month at 10.30 a.m. till disposal of the Appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 of Cr.P.C. and shall appear before the trial https://www.mhc.tn.gov.in/judis

directed by the trial Court.’
5. Barring the aforesaid modification, order dated 25.11.2025 passed in Crl.M.P.No.12033 of 2025 in Crl.A.No.701 of 2025 stands unaltered.
6. With this, this Miscellaneous Petition is ordered.
