Prayer sought in the Writ Petition is as under: “…….to issue a Writ Order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the inaction of the Respondents 2 to 6 in stopping the illegal erection of statue of Dr.B.R Ambedkar abutting to my property in Ac.0.92cents in Survey.No.154/3, on South side of Purtigada - Challapalli road stretch, Purtigadda Village and Challapalli Mandal, Krishna District, is illegal, arbitrary, unconstitutional, violative of fundamental rights as guaranteed under Article-14, 21 of the Constitution. of India and contrary to the Interim Order granted in I.A.No.10/2022 SLP (C) No.8915/2006 dt.18.01.2013 on the file of Supreme Court of India and also G.O.Ms.No.18 dt.18.02.2013 and direct the Respondents not to allow/permit for erection of the statue of Dr.B.R Ambedkar abutting to my property in Ac.0.92 cents in Survey.No.154/3, on South side of Purtigada - Challapalli road stretch, Purtigadda Village and Challapalli Mandal, Krishna District, and pass such…..” 3. Case of the petitioners is that they are absolute owners and possessors of the land situated in Sy.No.154/3 of an extent of Ac.0.92 cents, Challapalli Village and Mandal, Krishna District. Some of the villagers with the support of local authorities are attempting to erect a statue within the R&B road area adjoining the petitioners’ property, without acquisition of the petitioners’ land and without following due process of law. Hence, the petitioners submitted representation dated 15.06.2026 to the respondent authorities. But till today, no orders have been thereon. Hence, the Writ Petition. 4. Learned Assistant Government Pleader for Revenue has submitted the written instructions furnished by the Tahsildar, Challapalli Mandal. Copy of it is also furnished to the learned counsel for petitioners. 4 5. Relevant portion of the written instruction is extracted hereunder: “4. It is therefore submitted that the apprehensions expressed by the petitioners are not borne out by the factual position on ground. Since no statue has been erected and no permission has been granted by the Revenue authorities for such erection. the allegation of inaction on the part of the Tahsildar, Challapalli, is misconceived and without factual basis. The respondent authorities have acted diligently and there is no violation of any statutory provision or court order attributable to the Tahsildar. Challapalli.” 6. Pursuant to the written instructions, the learned Assistant Government Pleader would submit that no statue has been erected and no permission has been granted by the revenue authorities for such erection and that the respondent authorities. Recording the said submission, the Writ Petition is disposed of. No order as to costs.
