Muncipality. The said property belongs to Smt.R.Jayamma, who sold a portion of the property measuring 30x40 feet to Sri.Venkatesha and Smt.Nagalakshmi and the remaining property measuring 30 x 40 to the petitioner on 15.10.2007. 3. The petitioner applied for issuance of khatha in respect of the said property. The petitioner having made payment of the applicable taxes in respect of the same, post the purchase, the said application was not considered. As such, the petitioner filed W.P.No.57/2019 whereunder, this Court had remitted the matter to the respondents - BBMP to reconsider the matter afresh after obtaining all necessary documents from the hands of the petitioner. 4. The petitioner claims that all the documents have been submitted. The respondents once again on 21.03.2022 issued endorsement that no khatha can be issued to the petitioner without a layout plan sanction from the BDA being produced and payment of betterment charges of Rs.250/-. Challenging the same, the petitioner is before this Court. - 4 -

5. The submission of Sri.Chandraiah, learned counsel for the petitioner is that there being no layout plan sanction, the petitioner would not be in a position to produce the same. But however, the petitioner would make payment of betterment charges of Rs.250/- as sought for. 6. Sri.Ramu S., learned counsel for the respondents submits that if betterment charges are paid, the respondents would consider and issue khatha in respect of the property of the petitioner, as per the applicable rules. 7.
The said submission answers the grievance of the petitioner. In that view of the matter, I pass the following:-
ORDER i. The writ petition is partly allowed. ii. The Endorsement dated 21.03.2022 at Annexure - A is quashed. iii. Respondents are directed to consider and issue khatha in respect of property of the petitioner after collecting the betterment charges of Rs.250/-.
