02. 02. 07.10.2026 (D/L) (D/L) CT. NO. 05 CT. NO. 05 (ARPAN-A.R.CT.) In The High Court at Calcutta CONSTITUTIONAL WRIT Jurisdiction (Appellate Side) W.P.A. 25486 OF 2026 SHORAB HUSSIEN AND ANOTHER VS. THE STATE OF WEST BENGAL AND OTHERS …………… Mr. Samim Ahammed, Adv. Mr. Arka Ranjan Bhattacharya, Adv. Ms. Saloni Bhattacharya, Adv. Ms. Gulsanwara Parvin, Adv. … For Petitioners Ms. Amrita Pandey, Adv. Mr. Suraj Mishra, Adv. … For State 1. It is a case of inter-faith marriage and marriage scheduled to be solemnized on 29th July, 2026 but had to be postponed due to constant threat and intimidation by members of religious fundamentalist organizations as alleged in this writ petition. The notice period for solemnizing marriage expired on 25th September, 2026. 2. It was submitted on behalf of petitioners on last occasion that due to threat and intimidation marriage could not be solemnized thereby prompting petitioners to approach this Court with the present writ petition seeking necessary direction upon the concerned police authority to take steps which would facilitate the petitioners to take de novo steps for solemnizing marriage. A case is made out that jurisdictional Marriage Registrar being respondent no.5 might have been threatened as a result whereof he was reluctant to take further steps for marriage of petitioners. 3. In terms of order dated 25th September, 2026 Inspector- in-Charge, Nabadwip Police Station being respondent no.4 met respondent no.5 and it was apprised to [2] respondent no.4 that Marriage Registrar does not have difficulty in taking de novo steps for solemnizing marriage of petitioners. 4. Ms. Amrita Pandey, learned advocate representing State respondents undertakes to file report of respondent no.4 in course of this day. 5. Since it was expressed by respondent no.5 to respondent no.4 that respondent no.5 is willing to take steps for solemnizing marriage, petitioners shall be at liberty to take necessary steps, in accordance with law. 6. If it is decided by the petitioners that they will take steps for solemnizing marriage, in that event, it will be intimated to respondent no.4 based on which necessary police protection shall be provided to petitioners and their family members for completing formalities of marriage. 7. Writ petition stands disposed of. 8. Parties to act on the server copy of this order duly downloaded from the official website of this court. (SAUGATA BHATTACHARYYA, J.)
