ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH)
IN MFA No.3040/2020 C/w MFA Crob.No.56/2024
1. MFA No.3040/2020 and MFA.Crob.No.56/2024 have been filed against the judgment and award dated 05.11.2019 passed in MVC No.8/2018 by the Motor Accident Claims Tribunal, Sidlaghatta.
2. For the sake of convenience, the parties are referred to as per their rankings before the Tribunal.
3. Briefly, the facts leading to filing of the appeal and cross objection are that the deceased Bhagyamma was travelling in a Hero Honda Pleasure motorcycle bearing registration No.KA-51-S-8067 as a pillion rider along with her brother Murali towards Vijayapur on 04.11.2017, at around 09.45 p.m., when the motorcycle reached near Ravi Service Station, J.Venkatapura, they met with an accident with

F-726, which was allegedly driven in rash and negligent manner. As a result of the accident, both the rider and pillion rider died on the spot.
4. The claim petition came to be filed by the parents of the deceased Bhagyamma under Section 166 of the Motor Vehicles Act, 1988. The Tribunal, on considering the fact and evidence that the deceased was working as a Data Operator and was drawing a salary of Rs.12,606/- as per Ex.P10, and also considering the age of the deceased, added 40% as future prospects and deducted 1/3rd towards personal expenses of the deceased. Considering the age of the deceased, the multiplier of ‘15’, as per the
judgment in the case of Sarla Verma and Ors vs. Delhi Transport Corporation & Another1 was applied. Transportation charges for the body was awarded at Rs.10,000/- and funeral expenses was awarded at Rs.25,000/-. 5. It is not in dispute that the deceased was unmarried and she was around 39 years of age. However, in the post- mortem report, her age was mentioned as around 35

years. Neither the post mortem report nor the Aadhar Card is conclusive proof of the date of birth. As per the Secondary School Leaving Certificate at Ex.P3, her date of birth was recorded as 12.07.1978. Therefore, that would be the correct date of birth to be taken into consideration for determining her age. 6. Thus, at the time of accident, the deceased was around 39 years of age. The impugned award would also show that no compensation towards consortium was awarded to the claimants / parents of the deceased. As she was unmarried, instead of 1/3rd, the deduction ought to have been 1/2. Learned counsel for the respondents / cross- objectors does not dispute the fact that the deceased was unmarried and that except for the service certificate at Ex.P10, no other proof of income was produced by the claimants. 7. Considering the aforesaid facts, we are of the considered view that, instead of 1/3rd deduction towards personal expenses, the Tribunal ought to have deducted ½ from the income of the deceased towards the personal expenses of the deceased and should have awarded

consortium for two claimants at the rate of Rs.40,000/- each. 8. Thus, we recalculate the amount of compensation as under: Loss of dependency

Rs.15,88,320/- Loss of Consortium (Rs.40,000/- x 2) Rs. 80,000/- Funeral Expenses Rs. 15,000/- Loss of estate
Rs. 15,000/- TOTAL Rs.16,98,320/-
The claimants are entitled for interest at the rate of 6% per annum on the aforesaid amount, from the date of filing of the claim petition till the date of realisation. 9.
In view thereof, we direct for drawing the modified award for the compensation as assessed above along with interest at the rate of 6% per annum. Any statutory amount deposited in this Court for maintaining the appeal is directed to be remitted back to the Tribunal for disbursement. The apportionment, disbursement etc.,

11. The MFA No.3041/2020 and MFA Crob No.54/2024 arise out of the common
judgment and award dated 05.11.2019 passed by the Motor Accident Claims Tribunal, Sidlaghatta in MVC No.9/2018. The claimants are the wife and two children of late Murali.V and his parents. 12. For the sake of convenience, the parties are referred to as per their rankings before the Tribunal. 13. The case in brief of the claimants before the Tribunal was that, on 04.11.2017, while the deceased Murali along with his deceased sister Bhagyamma were travelling on a motorcycle bearing registration No.KA-51-S-8067, around 09.45 a.m., when they reached near Vijayapur-H Cross

Road, Near Ravi Service Station-J.Venkatapura, Sidlaghatta Taluk, they met with an accident with Karnataka State Road Transport Corporation (for short ‘KSRTC’) bus bearing registration No.KA-40-F-726. As a result of the accident, both the rider and the pillion rider died on the spot. 14. The claimants had filed the claim petition before the Tribunal under Section 166 of the Motor Vehicles Act, 1988 seeking compensation of Rs.66,00,000/- along with interest at 12% interest from the Corporation. 15. The learned Tribunal after examining the evidence brought on record, considered the income of the deceased at Rs.21,000/- per month i.e., Rs.16,000/- as salary, as per certificate - Exhibit P12, issued by the Horticulture Department and Rs.5,000/- as the agricultural income. 16. The deceased was 32 years of age. Therefore, future prospect at the rate of Rs.8,400/- was applied to the income so arrived at and a multiplier of 16 was also applied to assess the loss of dependency after deducting one-fourth (1/4th) towards the personal expenses. The

Tribunal has also awarded transportation charges as Rs.10,000/-, loss of consortium as Rs.1,00,000/-, funeral expenses as Rs.25,000/- and loss of care and protection of minor children as Rs.2,00,000/-. The total compensation was assessed at Rs.45,68,600/-. On the said amount of compensation, interest has been awarded at the rate of 9% per annum from the date of the claim petition till the date of realisation of the assessed compensation. 17. Smt.H.R.Renuka, learned counsel for the appellant submits that there was no proof of agricultural income of Rs.5,000/- per month.
The father of the deceased had 2 acres of land and the land was not in the name of the deceased. In the relevant column, there were no particulars of the crop being grown in the land of the father. Her submission is that, Rs.5,000/- per month taken towards the agricultural income is without any proper proof and support. She, however, does not dispute the certificate issued by the Horticulture Department in Exhibit P12, which would suggest that the deceased was

drawing Rs.16,000/- per month as salary from the Horticulture Department. 18. The age, the date of accident, involvement of the KSRTC bus, the proof of income of Rs.16,000/- per month, the age of the victim and dependants are not in dispute. However, so far as the income of Rs.5,000/- per month from agricultural income is concerned, there is not enough material to suggest that the deceased was doing agriculture and he was earning Rs.5,000/- per month from the 2 acres land, which was not in his name but in the name of his father. 19. Considering the aforesaid facts, we are of the opinion that Rs.5,000/- income from agriculture was not with proper proof, therefore, we are inclined to delete the said income from the income of the deceased. Thus, we take the income of the deceased as Rs.16,000/- per month, which would require addition of 40% as future prospects. Thus, the income of the deceased should be Rs.16,000/- per month plus 40% i.e., Rs.6,400/-, which would come to Rs.22,400 per month.
As the deceased had left behind wife and two minor children along with parents, the

deduction towards his personal expenses would be one fourth (1/4th) from the monthly income including 40% of the future prospect, it would come to Rs.22,400/- - 5,600 = Rs.16,800 per month. 20. Thus, we reassess the amount of compensation as under: Loss of dependency

We reduce the amount of compensation from Rs.45,68,600 to Rs.34,55,600/-. Considering that the deceased has left behind two minor children, we would not like to reduce the rate of interest from 9% to 6%. 21.
