This writ application has been preferred by the Petitioner for the following reliefs: (a) In the nature of mandamus commanding upon the respondents to show cause as to why and under what authority they have discriminated against the petitioner by not considering his promotion from E-6 to E-7 Grade with effect from 2012; (b) For a further direction upon the respondents to immediately and forthwith grant promotion to the petitioner from E-6 to E-7 Grade with effect from 2026:JHHC:828 2 2012 with all such consequential benefits as he may be entitled to by suitably modifying the order of his promotion contained in office order no. B-291 dated 26.05.2017 (Annexure-6) and /or by implementing the said order of promotion with effect from 2012 in respect of the petitioner only; 3. From the pleadings, it appears that the representation filed by the Petitioner for considering his name for promotion from E-6 to E-7 Grade is still pending before the Respondents. 4. Learned counsel for the parties fairly submits that the instant application may be disposed of in view of Paras-31 & 32 of the writ application to the effect that the representation is pending by giving direction to the concerned respondent to take a decision in the matter. 5. Having regard to the aforesaid submission and after going through Paras- 31 & 32, the instant writ application stands disposed of by directing the petitioner to file a fresh representation before the Respondent no.1- Chairman-cum-Managing Director, Coal India Ltd. within a period of 6 weeks. The moment, the concerned Respondent will receive the fresh representation, he shall pass an order after verification of the records as per applicable Rules and Regulations of the Respondent-Coal Company. The order shall be passed within a period of 12 weeks from the date of receipt of such representation. 6. Accordingly, the instant writ application stands disposed of.
