The learned counsel for the petitioner submitted that the petitioner is the absolute owner of the lands comprised in S.F. No. 151/3C, measuring an extent of 7.30 acres, and S.F. No. 151/5B, measuring an extent of 0.31 acres, situated at Jothampatti Village, Madathukulam Taluk, Tiruppur District. The subject property originally constituted joint family property, and the petitioner acquired title to the same by virtue of a registered Partition Deed dated

3. During the year 2006, based on applications submitted by the petitioner’s brothers, the revenue officials carried out subdivisions in S.F. No. 151/3C. However, the measurements reflected in the FMB sketch showed lesser dimensions than the actual extent available under the Partition Deed, which resulted in a shortage of 0.50 acres.
Hence, the petitioner submitted a detailed representation dated 04.12.2025, seeking the cancellation of the erroneous subdivisions and the restoration of the original survey numbers. Subsequently, the 2nd respondent cancelled the said subdivisions. 4. Thereafter, the petitioner submitted a representation to the 3rd respondent to survey the restored S.F. Nos. 151/3C and 151/5B, comprising a total extent of 7.61 acres, and to subdivide the same strictly in accordance with the registered Partition Deed. The petitioner also submitted an online application dated 15.05.2026 for the said purpose. Since the said application has not been considered, the petitioner has approached this Court. 5. Mr.B.Pachaiyappan, learned Government’s Counsel, who accepts notice on behalf of the respondents 1 to 4 would submit that the petitioner’s land will be surveyed and demarcated based on his online application dated 015.05.2026 along with necessary police aid, within a time frame to be fixed by this Court. https://www.mhc.tn.gov.in/judis

Heard the learned counsel for the petitioner as well as the learned Government’s Counsel appearing for the respondents. 7.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 3 and 4 consider the petitioner’s online application dated 15.05.2026 and conduct a survey and demarcate the subject properties, within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned. If any need arises for Police assistance, it is open to the respondents to request for Police protection from the jurisdictional Police. If any such request is made, the jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 8.In the event of any dispute regarding possession, the respondents shall not adjudicate upon the question of title.
The petitioner and the concerned parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court. https://www.mhc.tn.gov.in/judis
