OD-2 ORDER SHEET IN THE HIGH COURT AT CALCUTTA ORDINARY ORIGINAL CIVIL JURISDICTION CS/138/2025 IA NO. GA/1/2026 GUPTA POLYMERS INDUSTRIES AND ORS. VS ALL INDIA RUBBER INDUSTRIES ASSOCIATION AND ANR. BEFORE: The Hon’ble JUSTICE ARINDAM MUKHERJEE Date: 6th October, 2026. APPEARANCE: Ms. Aishwarya Rajyashree, Adv. Mr. Chandra Gupta Kamal, Adv. For plaintiff/petitioner THE COURT: This matter was adjourned at the time of presentation of plaint since a settlement was contemplated as submitted by the learned Advocate appearing on behalf of the proposed plaintiffs (hereinafter referred to as the plaintiffs). Ms. Aishwarya Rajyashree, learned advocate appearing on behalf of the plaintiffs submits that she has been instructed by the plaintiffs that the matter has been settled and as such there is no need for presenting the plaint. The plaint in the instant case, therefore, has been only filed in the Central Filing Section of this Court and has been allotted a number. The institution of the suit takes place only on the plaint being presented and admitted subject to scrutiny by the department when the plaint actually enters the record of this Court. This stage has not arisen in the instant case. 2 In the facts and circumstances as aforesaid the department is directed to return the plaint with court fees after completion of all formalities to the plaintiff. After return of the plaint, the department is directed to de-register the suit number from the data base so that the suit is not shown as pending in the data base of this Court. The application being GA/1/2026, in the facts and circumstances of the case, has also become infructuous and, as such, is not entertained. (ARINDAM MUKHERJEE, J.) Sb/
