OD-11 IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION ORIGINAL SIDE WPO/930/2025 SRIPATI KUMAR SHAW VS THE KOLKATA MUNICIPAL CORPORATION AND ORS. BEFORE THE HON’BLE JUSTICE RAJA BASU CHOWDHURY Date: 5th October, 2026 Appearance Mr. R. N. Chakraborty, Adv. Mr. Supratick Shyamal, Adv. Mr. Saikat Thakurata, Adv. …for the petitioner Mr. Biswajit Mukherjee, Adv. Ms. Susmita Chatterjee, Adv. …for the KMC 1. The learned Advocate for the petitioner would submit that though the writ petition has been filed praying for a direction upon the Kolkata Municipal Corporation to conclude the hearing initiated in respect of premises no.393/3F/2, Prince Anwar Shah Road, Kolkata – 700 068 and to pass a demolition order, however, since a demolition order has already been passed by the Special Officer (Building) on 26th December, 2025, he would submit that the writ petition has become infructuous. 2. The municipality is represented. Mr. Mukherjee, learned Advocate representing the municipality has placed before this Court a report of the Executive Engineer (Civil), Building Department, Borough–X. 3. From the above report, it would transpire that an appeal has already been filed before the Municipal Building Tribunal being BT Appeal No.21 of 2026 against the demolition order, as such, the order could not be implemented. 4. In view of the peculiar facts, nothing survives in the petition. The same is disposed of as having become infructuous. (RAJA BASU CHOWDHURY, J.) akg/
