This is an application under Section 482 of BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioners, namely, (1) Shoriful Islam and (2) Bisharat Ali, who are apprehending arrest in connection with the Abhayapuri P.S. Case No. 43/2026, registered under Section 117(2)/64/3(5) of the BNS, 2023. It is submitted by Mr. Borthakur, the learned Addl. P.P., Assam that the case has already been charge sheeted vide CS No.71/2026, dated 21.04.2026. On the other hand, it is submitted by Mr. Khan, the learned counsel that the accused petitioners have already appeared before the I.O., cooperated with the investigation of the case after obtaining the order of interim pre-arrest bail. However, as the case has already been charge sheeted, the accused petitioners are hereby directed to approach the learned Trial Court below with a regular bail application, which may be considered in accordance with the law. The interim bail, granted to the present petitioners may be extended for another fifteen (15) days, enabling them to appear before the learned Trial Court below, with a regular bail application.
