Nos. 3697, 3698 & 3701 of 2026 COMMON ORDER When the civil revision petitions are taken up, it is brought to the notice of this Court by the learned counsel for the petitioners that as against the judgment and decree dated 09.09.2025 passed in A.S. No. 35 of 2024 by the learned I Additional District Judge, Tindivanam, a Second Appeal has been filed by the petitioners before this Court in S.A. No. 444 of 2026. He would also submit that by order dated 06.07.2026 passed in C.M.P. No. 16087 of 2026 in S.A. No. 444 of 2026, the judgment and decree passed by the Lower Appellate Court in A.S. No. 35 of 2024 has been stayed in so far as passing of final decree alone is concerned. 2. The suit in O.S. No. 179 of 2018 on the file of Principal Sub Court, Tindivanam, was filed for partition and the petitioners herein were the defendants in the suit. Learned counsel for the petitioners submits that the very same grounds that have been raised in these civil revision petitions filed challenging the interim orders passed by the Lower Appellate Court pending disposal of A.S. No. 35 of 2024 have also been raised by the petitioners in S.A. No. 444 of 2026. Since the very same grounds have been 2\4 https://www.mhc.tn.gov.in/judis C.R.P. No. 444 of 2026 and further, when the petitioners are having the benefit of interim stay of the passing of final decree, by order dated 06.07.2026, in C.M.P. No. 16087 of 2026 in S.A. No. 444 of 2026, there is no requirement for this Court to pass any further orders in these civil revision petitions. Accordingly, these civil revision petitions are disposed of by confirming that the petitioners have raised the very same grounds in S.A. No. 444 of 2026, which has already been admitted by this Court and an order of interim stay has also been granted with regard to passing of final decree alone in C.M.P.
