On the death of the Testatrix, Khokan Barai filed the application for the grant of Probate of the Will. The Will is annexed with this application. Once the probate proceedings had been instituted, citations were issued. No caveat, however, was lodged, as a result of which the proceedings became non- contentious cause. The attesting witness and the Executor examined themselves as witnesses. The attesting witness deposed that the Testatrix executed the Will in presence of him and the other attesting witness. The attesting witnesses put their respective signatures in presence of the Testatrix. The attesting witness also deposed that at the time of making the Will, the Testatrix was in sound health and mind. The Executor also examined himself. The death certificate of the Testatrix was also produced and marked. On appreciation of the evidence and unchallenged testimony, this Court comes to the conclusion that petitioner has established his case and due execution of the will has been proved. Let probate be granted to the said last will and testament of the deceased dated 26th June, 1999. Inventory and accounts shall be filed within six months from the date of grant of probate. The instant probate application stands disposed of.
