Heard Mr. S Singh, the learned counsel appearing on behalf of the petitioner. Also heard Mr. R Talukdar, the learned Govt. Advocate, Assam who appears on behalf of the respondents. 2. The petitioner, who is the registered owner of a vehicle [TATA 407 (Water Tank)] bearing Registration No.AS-09AC-3219 is aggrieved by the non-release of the hire-charge bill to the petitioner which was hired by the respondent

At paragraph No.6 of the instant writ petition, the petitioner states that the petitioner is entitled to an amount of Rs.8,39,390/-, for the various periods, w.e.f. 01.12.2022 to 30.06.2024 the details of which have been given in the form of a table at paragraph 4 to the writ petition. On account of the non-payment of the hire-charge bills, the petitioner has approached this Court by filing the present writ petition. 3. This Court vide the order dated 08.12.2025 issued notice seeking a response from the respondent authorities. In pursuance thereto, an instruction/para-wise comment has been placed by the Senior Superintendent of Police dated 06.03.2026 which was kept on record and marked with the letter ‘X’.
In the said instructions, it is mentioned that the bills for the period from 01.12.2022 to 31.01.2023 of an amount of Rs.1,21,956/- have been verified and sent to the Assam Police Headquarters for necessary sanction. However, no bills for the period from 01.02.2023 to 31.05.2023 and 01.11.2023 to 30.06.2024 as has been mentioned at paragraph Nos.5 and 6 to the para-wise comment were received. 4. It is the opinion of this Court that as the amount of Rs.1,21,956/- has been duly verified and it is found that the petitioner is entitled for the period from 01.12.2022 to 31.01.2023, appropriate directions can be issued to the respondent authorities for payment within a reasonable period. Insofar as the other bills are concerned, more particularly for the period from 01.02.2023 to 31.05.2023 and 01.11.2023 to 30.06.2024 which the respondent authorities have stated that they have not received such bills, liberty can be granted to the petitioner to submit duplicate bills for due consideration for payment and accordingly upon due verification, the said payments can be made. 5. Accordingly the instant with petition stands disposed of with the following

The respondents herein jointly and severely are directed to pay the amount of Rs.1,21,956/- to the petitioner within a period of 6(six) months from the date a certified copy of the instant order is served upon the respondent No.6. (ii). The petitioner is granted the liberty to submit the duplicate copies of the bills for the period from 01.02.2023 to 31.05.2023 and 01.11.2023 to 30.06.2024 to the respondent No.6. (iii). Upon such submission of the bills by the petitioner, in terms with the liberty granted in Clause (ii) hereinabove, the respondent No.6 along with the other respondents concerned shall duly verify the same and upon verification, if found that the petitioner is entitled to any amount, the payments be made to the petitioner to the extent entitled. (iv).
The above verification as directed to be carried out in terms with Clause (iii) hereinabove be done within a period of 2(two) months from the date of submission of the duplicate bills by the petitioner and thereupon within 6(six) months thereafter, the payments be made to the petitioner to the extent the petitioner is found entitled to.
