APP Mr. Shiladitya Banerjee …for the State Learned senior counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. Charge sheet has already been submitted. There is hardly any overt act ascribed to the present petitioners. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of eye- witnesses including the ones made before the learned Magistrate. He also refers to the seizure list and the post mortem report. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. 2 Accordingly, the application for anticipatory bail of the petitioners is rejected.
