GP FOR REVENUE RC,J W.P.No.18352 of 2026 3 ORDER This writ petition is filed questioning the action of respondent authorities in contemplating to lay road in the private land of the petitioners situated at Gudekal Village, Yemmiganur Mandal, Kurnool District, without following the due process of law. 2. Heard Sri Butta Vijaya Bhasker, learned counsel for petitioners and Sri C.Praveen, learned Assistant Government Pleader for Roads & Buildings. 3. Sri Butta Vijaya Bhasker, learned counsel, while reiterating the contents of the writ affidavit would contend that the respondent authorities are trying to lay road in the private patta lands of the petitioners without following the due process contemplated under law, which they are not entitled to and hence the authorities may be directed not to lay road in the petitioners’ private patta lands except under due process of law. 4. Sri C.Praveen, learned Assistant Government Pleader, by placing on record the written instructions of the Executive Engineer, R&B Division, Adoni, vide Lr.Rc.No.Supdt./W.P.No. of 2026/2026-27, dated 07.07.2026 submitted that the authorities have temporarily dumped the residual material generated from the ongoing bridge construction works in the government Poramboke land which is adjacent to the lands of the petitioners, however the petitioners under misapprehension that a road will be laid in their lands filed the writ petition. He would further contended that the authorities had never intended RC,J W.P.No.18352 of 2026 4 to lay road in the petitioners lands and if they so intend they will follow due process of law and accordingly, prayed to dismiss the writ petition. 5. In response, learned counsel for petitioners prayed to record the contents of the written instructions and dispose of the writ petition. 6. In view of the submissions made by learned counsel, since the authorities clearly stated that they never intended to lay road in petitioners’ private patta lands and even if they so intend they would follow the due process contemplated under law, this writ petition can be disposed of. 7. Accordingly, the writ petition is disposed of, directing the authorities not to lay any road in the petitioners subject lands except under due process of law. There shall be no order as to costs.
