IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE R1 AND R4 TO CONSIDER THE RELEASE THE PETITIONER'S CONVICT SON MANJUNATH AT MANJU CTP 12917 PREMATURELY IN THE INTEREST OF JUSTICE. THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2026:KHC:6189 WP No. 8731/2025 ORAL ORDER The petitioner's son [Mr. Manjunath @ Manju, CTP - 12917] is convicted for the offences punishable under Sections 302, 364, 201 read with Section 34 of the Indian Penal Code and he has served over 13 years as a convict. The Advisory Board has resolved to recommend premature release of the petitioner's son, but the second respondent has refused to accept the recommendation because of a body warrant pending against him in C.C.No.54/2024 on the file of Principal Civil Judge and JMFC, Ballari. Mr. Sirajuddin Ahmed, the learned counsel for the petitioner, submits that this Court must pass just orders because the petitioner's son [the first accused] in C.C.No.54/2024 has been acquitted by the learned Magistrate on 26.10.2024 and that the co-accused with the petitioner in the original case in S.C.No.89/2012 has already been admitted to the benefit of premature release. - 4 - HC-KAR NC: 2026:KHC:6189 WP No. 8731/2025 Mr. B. Ravindranath, the learned Additional Government Advocate, is heard in the light of the afore. This Court is of the view that the petition must be disposed of calling upon the Life Convicts Release Committee [the second respondent] to consider the changed circumstances and to make appropriate recommendations on the petitioner's request for premature release of her son. The petition stands disposed of accordingly. RB Sd/- (B M SHYAM PRASAD) JUDGE
