Heard learned counsel of both sides. [2] The accused petitioner Ismail Miah has sought for bail through applicant Ikbal Hossain in connection with Sonamura P.S. case No.37 of 2026 registered under Sections 331(1)/118(2)/109(1)/351(2)/3(5) of BNS, 2023. [3]
As per the allegations made in the FIR, concerning the damage of certain household items by ducks, a quarrel took place between the victim- cum-informant Najmin Akhter and wife of the present accused and ultimately, the present accused initially hit her with a piece of wood and then by a dao which caused injury on her hand. She, thereafter, got treatment in the hospital. [4]
It is submitted by Mr. Sankar Lodh, learned counsel that after arrest, the present accused was produced before the learned Magistrate on 04.05.2026 and for 48 days he is in custody. Mr. Lodh, learned counsel
therefore earnestly prays for bail submitting that there are no ingredients of Sections 118(2) and 109(1) of BNS, 2023 in this case and for a considerable period, the accused person is in custody. [5]
Mr. Raju Datta, learned P.P. producing the case diary has opposed the bail prayer. [6]
Court has perused the materials available in the case diary. It appears that the Medical Officer has only found one lacerated injury on the right hand between thumb and index finger of the victim which was simple in nature. Investigation has also proceeded much. [7]
Considering all these aspect and also considering the incarceration of the accused for a considerable period, the bail prayer is allowed.

Accused person namely, Ismail Miah may go on bail on furnishing a bond of Rs.50,000/- (Rupees fifty thousand) with one surety of the like amount to the satisfaction of learned Elaka Magistrate on condition that- (i) he will give his attendance once in a fortnight to the investigating officer for next two months; (ii) he will not try to terrorize or influence any person acquainted with the fact of the case so as to dissuade him or them from divulging the truth before the Court; (iii) he will regularly attend the Court to face trial. Return the case diary to learned P.P. Send a copy of this order to the concerned Elaka Magistrate immediately.
