ORAL ORDER On the previous occasion, the following order was passed by this Court;
“Learned counsel for the petitioner submits that the petitioner who took voluntary retirement was holding the post of Wing Commander in the Indian Air Force. It is submitted that at the directions of this Court, the petitioner has already deposited a sum of Rs.1,35,750/-and the petitioner is willing to pay the balance and get the matter closed. Learned counsel submits that the chief contention of the petitioner in this Civil Revision Petition is that having regard to the bar contemplated under Section 15(d) & (e)(iv) of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, the suit could not be maintained before the Civil Court for recovery of the arrears of rent, if any. Having regard to the submissions made by the learned counsel for the petitioner, this Court is of the prima-facie opinion that the respondent - Union of India is required to consider the submission made by the learned counsel for the petitioner on behalf of the petitioner. If this Court were to go into the merits of the matter, more particularly the maintainability of the suit, then it would be further difficult for the respondents to recover the amount. Re-list this matter on 29.01.2026 to enable the respondents to consider the
