The contention made on behalf of the petitioners is that the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 has wrongly been invoked and that the petitioners are willing to surrender along with the bail application and that the contentions relating to the merits of the averments made is taken note of. 3.
Considering the above and the totality of the circumstances, the following directions are issued: (i) the petitioners shall surrender before the learned Principal District and Sessions Judge, Special Court for S.C and S.T Act, Kallakurichi District and file a bail application with reference to Crime No.307 of 2026 and the same shall be considered on merits on the same day; https://www.mhc.tn.gov.in/judis
