CRP No. 3687 of 2026 __________ Page1 of 4 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 08-07-2026 CORAM THE HON'BLE MR JUSTICE ABDUL QUDDHOSE CRP No. 3687 of 2026 1. C.Kannan 2. C.Chandran ..Petitioner(s) Vs 1. A.Kothandapani 2. V.Prakash 3. V.Aarthy 4. K.Govindarasu 5. N.Lakshmi 6. M.S.Adithyan 7. G.Rukmani 8. D.Sabitha 9. K.Meerabai 10.Latha 11.R.Punithavalli ..Respondent(s) This Civil Revision Petition has been filed under Article 227 of the Constitution of India seeking to set aside the fair and decreetal order passed IA No.2/2025 in OS No.55 of 2025 dated 25.02.2025 passed by Principal District Munsiff at Alandur. For Petitioner(s): Mr.S.Sarankumar https://www.mhc.tn.gov.in/judis CRP No. 3687 of 2026 __________ Page2 of 4 ORDER This Civil Revision Petition has been filed challenging the impugned order dated 25.02.2025 passed by the Principal District Munsif Court, Alandur, in I.A.No.2 of 2025 in O.S.No.55 of 2025. In the aforesaid order, the application filed by the petitioners, who are the plaintiffs in the suit, seeking for appointment of an Advocate Commissioner to note down the physical features of the suit schedule property has been dismissed on the ground that the petitioners/plaintiffs are attempting to collect evidence through appointment of an Advocate Commissioner. 2. The suit has been filed by the petitioners/plaintiffs against the respondents/defendants for permanent injunction. The main dispute relates to possession. Only through oral and documentary evidence, the petitioners/plaintiffs will have to prove their case. Instead, they have chosen to file an application seeking for appointment of an Advocate Commissioner. The trial Court has rightly held in the impugned order that the petitioners/plaintiffs are attempting to collect evidence through appointment of an Advocate Commissioner, which is legally impermissible. Therefore, this Court does not find any infirmity in the reasons given by the trial Court for dismissing the application filed by the petitioners/plaintiffs in I.A.No.2 of 2025. https://www.mhc.tn.gov.in/judis CRP No. 3687 of 2026 __________ Page3 of 4 3. Accordingly, this Civil Revision Petition is dismissed as devoid of any merit. No Costs.
