Bajiruddin Md.& anr. Vs. The State of West Bengal & ors.
Adv. Deborshi Dhar, … for the petitioner. Adv. Dipankar Sen, Adv. Bibek Tarafder, … for the State.
Affidavit of service filed by the petitioners is taken on record.
Learned counsel for the petitioners submits that the predecessor in interest of the petitioners was the recorded owner of the plots in question who expired leaving behind two sons Najumuddin Md. @ Najibaddin Md. and the 2nd petitioner as his surviving legal heirs. Subsequently, Najumuddin Md. @ Najibaddin Md. expired leaving behind the 1st petitioner as his sole legal heir, the petitioners thereby acquiring right, title and interest in respect of the plots. Sometime in August, 2025, officials from the office of the Block Land & Land Reforms Office, Rajganj arrived at the property and claimed that the property was acquired by the Government of West Bengal under the Land Acquisition Act, 1894. No notice of such acquisition was received by the petitioners/their predecessor in interest and no compensation was also awarded to them in lieu of such
2 acquisition. The petitioners submitted a representation ventilating their grievance before the concerned authority on 21st August, 2025 which is yet to be considered. The petitioners seek consideration of the same. In view of the fact that the representation submitted by the petitioners is still pending, the Special Land Acquisition Officer, Jalpaiguri, being the 3rd respondent herein is directed to consider and dispose of the same within six weeks from the date of communication of this
order upon granting reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is disposed of accordingly. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J)
