06.10.2026 Court No.07 Item No.5 AP HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI
CRM (A) 707 of 2026
In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pradhannagar Police Station Case No.638 of 2026 dated 31.08.2026 under Sections 318(3)/318(4)/61(2) of the BNS,
2023. And
In the matter of: Shatabdi Goswami @ Mampi …. Petitioner.
Mr. Jaydeep Kanta Bhowmik Mr. Sayantan Bhowmik Ms. Jasmin Haque Ms. Priti Das …for the Petitioner.
Mr. Avrojyoti Das, APP Ms. Suman Sehanabis Mr. Mayank Bhandari …for the State.
1. The application for anticipatory bail is canvassed on the ground that the petitioner is a lady and that she is employed with a finance company called Infinity Financial Solution. Her only fault is that she had facilitated the availment of loan of Rs.89,000/- by the de facto complainant.
2. Learned counsel for the State has produced the Case Diary.
3. It appears that while the petitioner and her associates have, in fact, facilitated the loan of Rs.89,000/- from a finance company called Bajaj Finance Limited. They have immediately purchased an iPhone in the name of the de facto complainant. A cash back
2 amount of Rs.39,000/- on purchase of the iPhone was made available to the de facto complainant. The petitioner and her associates have immediately re-sold the iPhone to a third party and appropriated the full value thereof. The petitioner used the mobile number of the de facto complainant to obtain OTP as well as her documents of identity for availing the personal loan. The de facto complainant being a gullible person has allowed a fraud to be perpetrated on her.
4. In the light of the above, this Court is inclined to accept the submission made on behalf of the counsel for the State that there is a full-fledged racket of persons like the petitioner herein, who are cheating innocent gullible people.
5. Having regard to the above, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the application for anticipatory bail is dismissed.
