CRP No. 3721 of 2026 2.Under the aforesaid order, an amendment application filed by the respondents 1 to 5 seeking to include additional properties in the Insolvency Petition has been allowed. 3.The Court below has allowed the said application on the ground that no prejudice will be caused to any of the parties as they will be given the right to object to the same in the main Insolvency Petition. 4.The petitioner claims that he has not borrowed any debt from respondents 1 to 5 and therefore, he cannot be declared as an Insolvent. According to the petitioner, he has purchased one property from the sixth respondent for a valuable sale consideration. According to the petitioner, there was no necessity for respondents 1 to 5 to include additional properties through the amendment application. 5.The court below has allowed the application only in the interest of the early disposal of the Insolvency Petition and to avoid any further delay. This Court does not find any infirmity in the reasons given by the court below for allowing the amendment application. If this petition is entertained at this stage when the Insolvency Petition is of the year 2015, it will only further delay the disposal of the Insolvency Petition. https://www.mhc.tn.gov.in/judis
