07.10.2026 Sl. No.15. Mithun Ct no. 5 (Rejected) Calcutta High Court
In the Circuit Bench at Jalpaiguri
C.R.M. (NDPS) 636 of 2026
In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with CR (NDPS) Case No.144 of 2025 arising out of Kharibari Police Station Case No.323 of 2025 dated 07.11.2025 under Sections 20 (b)(ii)(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 presently pending before learned Judge, Special Court (NDPS), 2nd Court, Siliguri. And
In the matter of : Shefali Singha …. Petitioner
Mr. Nigam Ashish Chakroborty, Mr. Agniva Banerjee, Ms. Avisikta Das, Ms. Angana Rakshit …for the Petitioner
Mr. Avrojyoti Das, Ld.APP, Mr. Bijoy Bikram Das, Mr. Atul Dong ...for the State
The allegation against the present petitioner is that 22.101 Kg of Ganja was recovered from the exclusive possession of three lady passengers which includes the present petitioner. Being aggrieved by the aforesaid proceeding, learned Counsel for the petitioner submits that the petitioner is languishing in custody for about 330 days. His further contention is that though charge-sheet has been submitted in this case on 24th April, 2026 but charge hearing has not yet been conducted. Prosecution proposes to examine 18
2 witnesses. Therefore, nobody knows when the trial will commence and when it will conclude. Further detention of the present petitioner will not yield any fruitful result and, as such, she may be released on bail on any terms and conditions. Learned Counsel appearing on behalf of the State opposed the bail prayer contending that all the three accused persons including the petitioner reside in the same locality and the recovery was made from their conscious joint possession and, as such, it clearly attracts the offence alleged against the petitioner. Having heard learned Counsel for the petitioner and the State, it appears from the seizure list that the rigors of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner and, as such, prayer for bail is considered and rejected at this stage. However, it appears that the charge-sheet was submitted on 24th April, 2024 but charge hearing has not yet been conducted.
Therefore, the Trial Court is directed to expedite the charge hearing considering the fact that the petitioner is in custody for a long period of time and he is requested to make every endeavour to conclude the charge hearing preferably within a period of 3 months from the next date of hearing. Accordingly, CRM (NDPS) 636 of 2026 is disposed of. 3 Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
