2026. 2.I have heard the learned counsel for the petitioner and the learned counsel for Tamil Nadu (Crl.Side) for the first respondent. 3.The gravamen of the allegations contained in the FIR is that all the accused mentioned in the FIR have indulged in holding of the urea and had also created a false records in the form of payment of GST, etc., so as to make it lawful. The present quash petition is filed by the petitioner/accused No.10. The case of the learned counsel for the petitioner is that the petitioner has studied only up to 5th standard and he doesn't even understand what GST means and therefore, an allegation is made against him that he prepared false GST records. Merely because he was associated with one of the accused on suspicion without even any prima facie conviction, he has also been included as an accused. 4.I have considered the said submission made by learned counsel for the petitioner. These submissions that is made is factual in nature, which will be gone into only during the course of the investigation. Such averments of the petitioner cannot be said to be incontrovertible, so as to entertain a quash application.
