W.P.(Crl).No.356 of 2026 For Petitioner : Mr.J.Rajmohan For R1 to R3 : Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) O R D E R This Writ Petition has been filed for a direction, directing the respondents 2 and 3 to take appropriate action as against the 4th respondent in pursuant to the direction issued by the 1st respondent, dated 13.06.2025. 2. Heard the learned counsel appearing on either side and perused the materials placed on record. 3. The petitioner is the father of the 4th respondent herein. The 4th respondent failed to maintain the petitioner as if, the petitioner was constrained to approach the 1st respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. After due enquiry, the 1st respondent by an order dated 27.01.2025 directed the 4th respondent to vacate the premises, which is in possession and enjoyment of the petitioner and directed the jurisdiction police to take appropriate action as against the 4th respondent, if any illegality committed by him. W.P.(Crl).No.356 of 2026 has not been complied with by the 4th respondent and as such, once again the petitioner approached the 1st respondent for appropriate orders. Considering the representation submitted by the petitioner, the 1st respondent by an order dated 13.06.2025 directed the 2nd respondent to take appropriate action as against the 4th respondent under Section 233 of BNSS Act, 2023. Even then, the 2nd respondent did not take action so far. 4.
In view of the above, the respondents 2 and 3 are directed to take appropriate action as against the 4th respondent as directed by the 1st respondent by an order dated 13.06.2025, forthwith and ensure that the 4th respondent vacate the premises and handover the same to the petitioner. 5.
