Claim Application under Section 166 of the MV Act was filed by the appellant/claimants inter alia seeking compensation on account of death of Akash Beck in a road accident which took place on 09.02.2023 at Gumla, Jharkhand. Said application was rejected by the Tribunal holding that cause of action had not arisen in its jurisdiction and for that the application was not maintainable. 3. After arguing for some time, counsel for the appellants submits that he may be permitted to withdraw this appeal with liberty to file a duly constituted claim application under Section 166 MV Act before the jurisdictional Claims Tribunal. 4. The appeal is therefore dismissed as withdrawn with liberty as aforesaid.
