The petitioner claims to be the owner of L.R. Dag No.31, Khatian No.4171, J.L. No.106 within Mouza-Haulia under Police Station-Tehatta in the District of Nadia. The petitioner alleges that the private respondents have raised an unauthorised construction by encroaching upon the Government land. The petitioner claims to have submitted a representation dated July 31, 2025 before the Sub Divisional Officer, Tehatta, Nadia. The learned advocate appearing for the petitioner submits that in spite of receipt of such representation, no steps have been taken in accordance with law. The learned advocate appearing for the State submits that necessary steps in accordance with law shall 2 be taken within the time limit as may be specified by this Court. The learned advocate appearing for the private respondents denies the allegation of the petitioner that the private respondents have encroached upon any portion of the Government land. Without entering into the merits of the claim made in the representation dated July 31, 2025, WPA 21524 of 2025 stands disposed of by directing the Sub Divisional Officer, Tehatta, Nadia, to consider the representation of the petitioner dated July 31, 2025 and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner, the private respondents and any other persons, who may be affected by such decision. The reasoned order shall be communicated to the petitioner, private respondents and other affected parties within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated July 31, 2025.
