WP No. 25738 of 2026 __________ Page2 of 5 For Petitioner(s): Mr.T.Elumalai For Respondent(s): Mr.B.Pachaiyappan, Government Counsel Order This Writ Petition has been filed to direct the 2nd Respondent to dispose of the petitioner Application dated 05.03.2025 seeking restoration of patta for the said lands in the petitioner’s name. 2. The learned counsel for the petitioner submitted that the petitioner’s mother purchased the property measuring an extent of 0.22.5 hectares in S.F. No. 165/2G through a registered Sale Deed dated 11.05.1986. Her mother subsequently executed a Gift Settlement Deed in favour of the petitioner. The same was duly registered, and a patta was also issued in favour of the petitioner, who is in absolute possession and enjoyment of the property. 3. While so, on 08.10.2011, the 2nd respondent, without issuing any notice to the petitioner, removed her name from the patta and mutated it in favour of one Sivappa. Taking advantage of this erroneous entry, the said Sivappa trespassed into the petitioner’s property. Consequently, the petitioner filed a suit before the Civil Court in O.S. No. 102 of 2011, which was decreed in favour of the petitioner on 29.08.2023. Since the said application was not considered, the petitioner has approached this Court by way of this Writ Petition. 4. In reply, Mr.B.Pachaiyappan, learned Government Counsel who takes notice on behalf of the respondents would submit that the petitioner’s application dated 05.03.2025 will be disposed of by the respondents within a period of three weeks. 5. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record. 6. In view of the above, this Court directs the 2nd respondent to consider the petitioner’s representation dated 05.03.2025 on its own merits and dispose of the same in accordance with law within a period of six weeks from the date of receipt of copy of this order. 7.
