THIS WRIT APPEAL, COMING ON FOR ORDERS, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE D K SINGH & HON'BLE MS. JUSTICE TARA VITASTA GANJU ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH) 1. The present intra-Court appeal is filed by the appellant, praying for setting aside the order dated - 3 - HC-KAR NC: 2026:KHC:5750-DB WA No. 316 of 2025 16.01.2025 passed by the learned Single Judge in Writ Petition No.34532/2024 (LB-BMP). In the Writ petition, the petitioner had sought for setting aside the order dated 27.11.2024 passed by the Chief Commissioner, Bruhat Bengaluru Nagara Palike [BBMP], communicated by the Deputy Commissioner (Administration), Bengaluru, repatriating the petitioner to his Parent Department. 2. The parties are referred to as per their ranking before the Writ Court, for the sake of convenience. 3. The petitioner is employed as “Environmental Engineer” in the Department of Urban Administration. The deputation order itself mentions that if the BBMP would not find his services satisfactory, the BBMP would have the right to repatriate him forthwith, without prior notice. There were complaints against the petitioner and finding some substance in the complaints, vide the impugned order, the petitioner’s deputation with the BBMP has been - 4 - HC-KAR NC: 2026:KHC:5750-DB WA No. 316 of 2025 terminated and he has been repatriated to his Parent Department. 4. When the deputation order itself mentioned that if the BBMP does not find his services satisfactory, the BBMP would have a right to repatriate him forthwith, without notice, we do not find that the petitioner has any right to continue on deputation in the BBMP, particularly, after he has almost completed his initial three years in the BBMP. Therefore, we do not find any ground to interfere with the impugned order passed by the learned Single Judge. We find no merit in the appeal and therefore it is dismissed. All pending applications stand closed.
