(2) According to petitioners, they were appointed as Part-time Voluntary Lecturer in different government colleges in erstwhile State of Uttar Pradesh, in the year 1987. Their designation was changed to Shikshak Bandhu, vide order dated 24.5.2005 and ultimately their services were regularised on the post of Lecturer vide order dated 17.5.2014. Since benefit of Old Pension Scheme has not been extended to petitioners, therefore, they have approached this Court seeking the benefit of Government Order dated 26.12.2023. (3) Government Order dated 26.12.2023 is on record as Annexure-1 to the writ petition. It provides that persons even though appointed after 1.10.2005, if participated in the process of selection which commenced before 1.10.2005, shall also be covered by Old Pension Scheme. (4) Learned Counsel for the petitioners contends that petitioners’ case is covered by para 2(1) of the aforesaid government order, therefore petitioners are entitled to benefit of Old Pension Scheme. (5) Learned State Counsel, however, submits that if petitioners make representation to the competent authority, decision thereupon shall be taken as per 2026:UHC:95 law. (6) Having regard to the facts of the case, writ petition is disposed of by permitting the petitioners to make representation to Director, Higher Education. If petitioners make representation within two weeks from today, decision thereupon shall be taken, as per law, within four months thereafter.
