The matter has been listed under the category of default on account of a fundamental procedural defect, inasmuch as petitioners No.2 and 3 have not appended their signatures on the Vakalatnama. The absence of proper authorization in favour of the learned counsel renders the petition defective and not maintainable in its present form. 3. In light of the aforesaid lapse, which reflects a lack of due diligence in ensuring compliance with basic procedural requirements, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file a fresh petition. 4. This Court deems it appropriate to observe that such casual filing of petitions, without ensuring that the Vakalatnama is duly executed by all the petitioners, cannot be countenanced. Members of the Bar are expected to remain vigilant and exercise necessary care while instituting proceedings before the Court. Be that as it may, liberty is granted to file a fresh, duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn, with liberty as prayed for, subject to the petitioners depositing costs of Rs.1,500/- in the Registry of this Court within a period of one week from today. The said amount shall be transmitted to the Government Special School for Visual Handicapped, Boys and Girls Jashpur (C.G.). 3 6. Certified copies of the documents annexed to the petition, if any, shall be returned to learned counsel for the petitioners after retaining photocopies thereof on record, subject to deposit of the aforesaid costs.
