Police filed charge sheet. Obviously, no recovery was made from the custody of the petitioner. Police at this stage is unable to establish the nexus between the petitioner and the seized commercial quantity of narcotics. No criminal antecedents of the petitioner is brought to the notice of the Court. In such circumstances, I am of the view that the petitioner is able to overcome the restrictions under Section 37 of the NDPS Act. Consequently, I grant anticipatory bail to the petitioner. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the
2 conditions as laid down under Section 482 (2) of the B.N.S.S.,
2023. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. This application for anticipatory bail is, thus, allowed. Memorandum of evidence filed in Court be kept on record. (Debangsu Basak, J.)
