At this stage, learned counsel appearing for the petitioners, has drawn the attention of this Court towards the order dated 07.01.2023, passed by the learned Civil Judge, Manali, District Kullu, H.P. (hereinafter referred to as ‘the trial Court’), where the lis was pending, which is reproduced as under: “Case called repeatedly since morning, but none has appeared on behalf of the plaintiff.  It is already 4:00 pm and cause list for the day also stands exhausted. It appears that absence on behalf of the plaintiff is deliberate   and   intentional   and   the   same   is   not interested to pursue the matter in hand.  Accordingly, the case in hand is dismissed in default for want of 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:15036 prosecution.  Matter is accordingly disposed of.  File, after due completion, be consigned to record room.
