Bhimavarm Town Police i.e.. Respondent Nos.3 to 5 not call the petitioner, not to detain the Petitioner in the S.H.O. The Court made the following Order:
The present Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, to declare High Handed acts of the Police i.e., Respondents Nos.3 to 5 by calling the petitioner on 22.06.2026 to the S.H.O. Town Police Station, West Godavari District and man handling the Petitioner without there being any offence committed by the petitioner is ill-legal and arbitrary, consequently direct the police to take appropriate action as per law against the Respondents Nos.6 to 9 who brutally beat and tried to kill the petitioner on 04.06.2026 and investigate the case in the interest of justice and to pass such other order or orders ….”
2. Today, when the matter was taken up for hearing, the learned Assistant Government Pleader for Home, appearing on behalf of the official respondent Nos. 1 to 4, on instructions, submitted that, in terms of the statement recorded by the Assistant Sub-Inspector of Police on 05.06.2026, the Police have registered an FIR in Crime No. 129 of 2026 of Bhimavaram I Town Police Station, West Godavari District, for the offences punishable under Sections 118(1) and 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, and are conducting investigation. He also produced a copy of the said FIR. The same is taken on record and made part of the Court record. 3. A copy of the said FIR is also furnished to the learned counsel for the petitioner. 4 MRK,J W.P.No.17299 of 2026
4. In view of the above, this Writ Petition is closed, leaving it open to the petitioner to work out his legal remedies in accordance with law. It is also made clear that the Police shall investigate the crime in accordance with law. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed.
