Crl.O.P.No.14691 of 2026
ORDER This Criminal Original Petition is filed with a prayer to modify a condition in the order of the learned District Munsif-cum-Judicial Magistrate, Uthukottai, dated 18.03.2026 made in Crl.M.P.No.74 of 2026.
2. The petitioner is an accused who said to have transported the banned tobacco products in a two wheeler and as such, the case is registered in Crime No.33 of 2026 for the offences under Sections 123, 275, 276 of B.N.S read with Section 24(1) of the COTPA Act.
3. The learned Counsel would submit that even though the return of vehicle was ordered as early as on 18.03.2026, the vehicle is lying in the Court custody as the petitioner is unable to satisfy the Court for execution of bond for a sum of Rs.50,000/- along with two sureties. The learned Counsel would submit that the amount shall be reduced.
4. I have also heard the learned Government Advocate (Criminal Side) for the respondent.
5. Considering the nature of the vehicle involved and the year of 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.No.14691 of 2026 purchase etc., only on account of the pleading made by the learned Counsel for the petitioner that inspite of best efforts, the petitioner is not in a position to muster solvency for a sum of Rs.50,000/- and that the vehicle would be rotting, I am of the view that the amount mentioned in the impugned order as Rs.50,000/- can be modified to be one of Rs.20,000/-.
6. In view thereof, this Criminal Original Petition is partly allowed by modifying the sum mentioned in the order, dated 18.03.2026 passed by the learned District Munsif-cum-Judicial Magistrate, Uthukottai, in Crl.M.P.No.74 of 2026, in paragraph No.5(1) as Rs.20,000/- in the place of Rs.50,000/-. The other conditions shall remain the same. 06.07.2026 Neutral Citation : yes/no grs To
