THESE APPEALS COMING ON FOR ORDERS THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER: CORAM: HON'BLE MRS. JUSTICE P SREE SUDHA ORAL JUDGMENT Though these matters have come up for admission, with consent of learned counsel for parties, they are taken up for hearing and disposed of by this judgment. 2. Common award was passed by the III Additional Senior Civil Judge and JMFC, Davanagere, in MVC Nos.305 of 2022 and 306 of 2022 on 29.08.2023. 3. In M.F.A. No.1620 of 2024 : This appeal is filed against the judgment and award passed by the Tribunal in MVC No.305 of 2022. The injured claimant, aged 52 years, doing agriculture met with an accident on 27.12.2021, and filed a claim application claiming compensation of Rs.20,00,000/- with interest. The Tribunal, considering the entire evidence on record, granted the - 4 - HC-KAR NC: 2026:KHC:4754 MFA No. 1620 of 2024 C/W MFA No. 1603 of 2024 compensation of Rs.3,16,300/- with interest at the rate of 6% per annum from the date of petition till realisation. 4. Aggrieved by the said order, this appeal is preferred by the appellant-claimant in which it is mainly contended that she sustained compound type 2 right middle one third communited humerus shaft fracture with DNVD and other injuries, but the Tribunal granted meagre amounts under the other heads and thus, requested for enhancement of the compensation. 5. Heard the arguments of learned counsel for both sides. 6. Petitioner-claimant has stated that she was doing agriculture and earning Rs.10,000/- per month. But, she has not filed any income proof. As she met with an accident in the year 2021, her notional income is to be taken as Rs.15,000/- per month. Learned counsel for the respondent insurance company stated that the petitioner herself admitted her income as Rs.10,000/- per month and it is to be taken as Rs.10,000/- per month only. But, when there is no income proof, this Court - 5 - HC-KAR NC: 2026:KHC:4754 MFA No. 1620 of 2024 C/W MFA No. 1603 of 2024 is relying upon the chart prepared by the Karnataka State Legal Services Authority and therefore, this Court finds it reasonable to take her notional income as Rs.15,000/- per month. As this beneficial legislation, which ever is beneficial to the litigant is to be considered. The petitioner was aged 53 years as per Exhibit P8 and other medical records and thus, the multiplier is to be taken as 11. 7. As per the wound certificate, the petitioner sustained grievous injuries. Petitioner examined PW2-doctor and stated as follows: “1. XXXXX 2. XXXXX 3. XXXXXX sustained injury to Head Face, Right arm, She complained of pain and swelling over right arm and could not move right arm and left objects in right hand after trauma. Finally, the doctor assessed permanent physical disability of 20% regarding the right upper limb. However, the Tribunal assessed the whole body disability as 6%. As there is shortening of right upper limb and deformity present over middle third of the right arm, this Court finds it reasonable to take the disability as 10%. So, the loss of future earning capacity comes to Rs.1,98,000/- (15,000x12x11x10%). The Tribunal granted Rs.80,900/- towards medical expenses and it is confirmed. The petitioner was hospitalised for a period of 5 days. Therefore, considering the nature of injuries, her occupation and the period of hospitalisation, this Court finds it reasonable to grant an amount of Rs.50,000/- for pain and - 8 - HC-KAR NC: 2026:KHC:4754 MFA No. 1620 of 2024 C/W MFA No. 1603 of 2024 suffering, Rs.25,000/- for loss of amenities, Rs.30,000/- for transportation, extra nourishment and attendant charges.
