ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER
Learned counsel for the petitioner has filed a memo dated 04.12.2025 stating that after the impugned order dated 22.11.2023 was passed by the trial court rejecting the application filed by the petitioner under Order VII Rule 11, the 1st respondent, who is not a partner of the firm seems to have executed an agreement of sale dated 21.10.2022 in respect of a portion of the suit schedule property in favour of a third party. In that regard, the petitioners have filed an application to implead the agreement holder in the suit and the petitioners have also filed an application to amend their written statement seeking a prayer for cancellation of the said agreement of sale by way of a counter claim.

2. In that view of the matter, and in view of the subsequent developments, learned counsel submits that the Civil Revision Petition may be disposed of, while also permitting the petitioners’ herein who are defendants No.1 and 2 to withdraw I.A.No.6, which was filed under Order VII Rule 11. It is also stated that the plaintiff had sought for amendment of the plaint and since the said application was allowed, the petitioners have filed W.P.No.2961 of 2025 (GM-CPC), which is pending consideration before this court. It is therefore stated in the application that depending on the outcome of the said writ petition, if necessary, the petitioners will take the next step.
5. Having regard to the statements made in the memo and in view of the prayer made in the memo seeking leave of this Court to withdraw I.A.No.6 on which an order is already passed by the trial court, this Court is of the considered opinion that no prejudice will be caused to the respondent plaintiffs if this Civil Revision Petition is
