Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 126(2), 75, 76, 77, 78, 351(2), 3(5) of the Bharatiya Nyaya Sanhita and under Section 8/12 of POCSO Act in connection with Govindpur PS Case No. 457 of 2025 corresponding to Special POCSO Case No. 145 of 2025. In this case, charge has been framed under Section 75 of the B.N.S., 2023 and under Section 8 of POCSO Act.

Learned senior counsel for the petitioner submits that the petitioner is innocent and has not outraged the modesty of minor girl.
Learned counsel submits that there are major contradictions in the statement of victim made under Section 180 and under Section 183 of BNSS, 2023 which would falsify the prosecution case. Learned senior counsel further refers to several paragraphs of the deposition of the prosecution witness and submits that the petitioner has been falsely implicated in this case. He submits that the petitioner is in custody since 28.11.2025 as such the petitioner may be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioner.

Having regard to the allegation made against the petitioner coupled with the deposition of the alleged victim in para nos. 19 to 23 and

also para 12 of the disposition of PW2, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Act, Dhanbad in connection with Govindpur PS Case No. 457 of 2025 corresponding to Special POCSO Case No. 145 of 2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stands allowed.
