J. Baruah, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioners, namely, 1. Sri Ranoj Pegu, 2.Sri Bimal Pachung, 3. Sri Birgu Pegu and 4. Sri Girish Pegu have prayed for releasing them on bail after they were arrested in connection with Gohpur P.S. Case No.11/2026 registered under Section 25(1-A) of the Arms Act, 1959. 3. The case of the prosecution briefly put is that upon statements of one co-accused, a search was made in the house of the petitioner No.2, Bimal Pachung and a Single Barrel 12 Bore Gun was recovered. The other petitioners were also arrested on the basis of the statements of the co-accused Biswarup Mili (Dakkar). 4. The case is registered under Section 25(1-A) of the Arms Act, 1959, which concerns prohibited arms, i.e. automatic firearms, but the present case appears to be covered by Section 25(1) (a) Arms Act. 5. Mr. R. J. Baruah, learned Additional Public Prosecutor appearing for the State of Assam submits that the matter is pending for further investigation and Page No.# 3/3 that FSL report reveals that the recovered arm is serviceable. 6. Be that as it may, having regard to the fact that the petitioners have been arrested on the basis of the statements of the co-accused and that they have already spent 77 days behind the bars, the prayer for bail is allowed. Accordingly, the accused/petitioners namely, 1. Sri Ranoj Pegu, 2.Sri Bimal Pachung, 3. Sri Birgu Pegu and 4. Sri Girish Pegu shall be released on bail of ₹50,000/- (Rupees fifty thousand) only each with two sureties of like amount to the satisfaction of the learned SDJM (M), Gohpur. 7. It is further provided that the petitioners shall co-operate with the investigation and shall not hamper or tamper with the investigation in any manner. 8.
