This revisional application has been filed against an order dated December 11, 2025 passed by the learned Civil Judge (Junior Division), Tehatta, Nadia thereby dismissing Miscellaneous Case No. 21 of 2016 filed under Order 21 Rule 101 read with Section 151 of the Code of Civil Procedure, 1908 in connection with Title Execution Case No. 12 of 2015. 2. An order passed on an application under Order 21 Rule 97 to 101 is appealable under Order 21 Rule 103 of the Code of Civil Procedure, 1908. 3. In such view of the matter, this revisional application is not maintainable. 4. Accordingly, C.O. 1054 of 2026 is dismissed. 5. There shall be no order as to costs. 6. The petitioner shall be at liberty to take back the certified copy of the order dated December 11, 2025 which has been impugned herein upon furnishing a 2 Photostat copy thereof duly countersigned by the learned advocate on record for the petitioner. 7. This order shall not preclude the petitioner from challenging the aforesaid order dated December 11, 2025 in accordance with law. (Om Narayan Rai, J.)
